TERMS AND CONDITIONS OF USE

These Terms and Conditions ("Terms") govern your access to and use of the website, mobile application, YouTube channel, educational content, courses, products, services, and all related platforms operated by 366 Infinity Education Academy Private Limited (“366IEA”, "Company", "we", "our", or "us").

By accessing or using the Platform, you agree to be legally bound by these Terms. If you do not agree to these Terms, you must discontinue use of the Platform immediately.

1. DEFINITIONS

"Platform" means the website, mobile application, YouTube channel, digital products, online courses, live classes, recorded lectures, test series, books, study materials, communities, and services offered by 366IEA.

"User" means any person accessing or using the Platform.

"Content" includes lectures, videos, audio recordings, PDFs, notes, tests, question banks, graphics, trademarks, software, and any educational material available through the Platform.

2. ELIGIBILITY

Users must be legally competent to enter into a binding contract under applicable laws.

3. USER ACCOUNT

Users may be required to create an account to access certain services.

The User agrees to:

• Provide accurate information which is true to the user’s knowledge.
• Keep login credentials confidential.
• Be responsible and liable for all activities conducted through the account.
• Immediately notify the Company of any unauthorized access and activities.

The Company reserves the right to suspend or terminate any account for violation of these Terms.

4. LICENSE TO USE PLATFORM

The Company grants Users a limited, non-exclusive, non-transferable, revocable license to access and use the Platform solely for personal educational purposes. No ownership rights are transferred to Users. Users are strictly prohibited from copying, reproducing, replicating, distributing, modifying, or creating derivative works of any content, code, or materials etc from the Platform.

• Software

Users shall not copy, reproduce, modify, publish, distribute, transmit, sell, license, create derivative works from, or otherwise exploit any Content without prior written permission.

7. USER GENERATED CONTENT

Users may submit comments, questions, assignments, reviews, testimonials, photographs, videos, or other content ("User Content").

By submitting User Content, the User grants the Company a worldwide, royalty-free, perpetual, irrevocable, non-exclusive license to use, reproduce, publish, display, distribute, adapt, and promote such content in connection with the Platform.

The User warrants that such content does not infringe any third-party rights.

8. TESTIMONIALS AND MEDIA CONSENT

Where a User voluntarily submits:

• Testimonials
• Reviews
• Success stories
• Academic achievements
• Photographs
• Videos
• Audio recordings

The Company may use such materials for educational, promotional, advertising, branding, and awareness purposes across digital and print media and the same shall be treated as the property of the company.

Users acknowledge that no compensation shall be payable for such usage in any condition.

9. LIVE CLASSES AND RECORDED SESSIONS

The Company may record live classes, webinars, workshops, mentoring sessions, or other educational interactions.

By participating in such sessions, Users consent to such recording and use for educational, operational, quality control, security, and training purposes.

10. COMMUNICATIONS

Users consent to receive communications from the Company through:

• Email
• SMS
• WhatsApp
• Phone calls
• Push notifications
• In-app messages

These communications may include service notifications, course updates, reminders, promotional offers, and educational announcements.

Users may opt out of promotional communications where applicable.

11. THIRD-PARTY SERVICES

The Platform may integrate third-party services including payment gateways, communication tools, analytics providers, and cloud hosting services.

The Company shall not be responsible for the practices, policies, or content of such third parties.

12. DISCLAIMER OF WARRANTIES

The Platform and all Content are provided on an "AS IS" and "AS AVAILABLE" basis.

The Company does not guarantee:

• Uninterrupted availability;
• Error-free operation;
• Accuracy or completeness of Content;
• Examination success;
• Academic performance;
• Employment opportunities.

Educational outcomes depend upon individual effort and circumstances.

13. LIMITATION OF LIABILITY

To the maximum extent permitted by law, the Company shall not be liable for:

• Loss of profits;

• Technical failures beyond reasonable control.

The total liability of the Company shall not exceed the amount actually paid by the User for the relevant service during the preceding six months.

14. INDEMNIFICATION

Users agree to indemnify and hold harmless the Company, its directors, employees, affiliates, agents, and representatives from any claims, liabilities, damages, losses, or expenses arising from:

• Violation of these Terms;
• Misuse of the Platform;
• Infringement of third-party rights;
• User Content submitted by the User.

15. TERMINATION

The Company may suspend or terminate access to the Platform without notice where:

• These Terms are violated;
• Fraudulent activity is suspected;
• Security concerns arise;
• Required by law.

Termination shall not affect accrued rights or obligations.

16. FORCE MAJEURE

The Company shall not be liable for delay or failure to perform obligations resulting from events beyond reasonable control, including:

• Natural disasters;
• Internet outages;
• Government actions or policies;
• Pandemics;
• War;
• Cyberattacks;
• Power failures.
• Education ministry or Boards actions or policies

17. GOVERNING LAW

These Terms shall be governed and construed in accordance with the laws of India.

Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts located at Mumbai, India.

18. CHANGES TO TERMS

The Company reserves the right to modify these Terms at any time.

Updated Terms shall become effective upon publication on the Platform.

Continued use of the Platform constitutes acceptance of such modifications.
